Summary. Food4Foodies is a marketplace. Independent Chefs prepare and sell the food, independent
courier networks deliver it when a Foodie chooses delivery, and independent Organizers run events. F4F provides the
technology and payment tools that connect them. This summary is for convenience only; the full Terms below are what
apply to you.
1. Agreement to These Terms
These Terms of Service (the "Terms") are a binding agreement between you and Food For Foodies, LLC, a Maryland limited
liability company doing business as Food4Foodies ("F4F", "we", "us", or "our"). They govern your access to and use of the Food4Foodies mobile applications, our website, our application
programming interfaces and connected tools, and all related services (together, the "Service"). By creating an
account, tapping to accept these Terms, or otherwise accessing or using the Service, you agree to be bound by these
Terms and by our Privacy Policy, which is incorporated into them. If you do not agree, you
may not use the Service.
2. Our Role
F4F is a technology platform and marketplace. We connect independent home chefs ("Chefs") with people who want
home-cooked and traditional food ("Foodies"), and we provide tools for discovery, ordering, scheduling, messaging,
payment, and dispute handling. F4F is not a restaurant, food preparer, caterer, courier, or event organizer.
-
Chefs are independent. Chefs are independent individuals or small businesses. They are not employees,
agents, partners, or joint venturers of F4F. Each Chef decides what to cook, at what price, and when, and is solely
responsible for the food they prepare and for complying with the laws that apply to them.
-
Disputes are between Chefs and Foodies. Any disagreement or concern about food, including its
quality, safety, ingredients, allergens, effects on health, or whether the Chef held the permits or licenses
needed to sell it, is between the Foodie and the Chef who prepared it.
F4F is not a party to the sale and has no obligation to investigate, mediate, decide, or resolve these disputes,
whether through legal proceedings or otherwise. The complaint and refund tools described in Section 12 are offered
as a convenience to help Foodies and Chefs settle issues between themselves; using them, or any review F4F chooses
to make, does not make F4F responsible for the food or for the outcome.
-
Couriers are independent. When a Foodie chooses delivery, the delivery is performed by an
independent third-party courier network. F4F does not operate a delivery fleet or employ couriers (see Section 9).
-
Organizers are independent. Event4Foodies events are created and run by independent Organizers,
who are Chefs using an additional capability on their account. F4F does not organize, host, insure, or supervise
any event (see Section 11).
-
We are not a party to your transactions. A contract for food, a Chef@Home visit, or event
participation is formed directly between the Foodie and the Chef (or between a Chef and an Organizer). F4F
facilitates and processes the payment but is not a party to that contract.
3. Eligibility & Accounts
- You must be at least 18 years old and able to form a binding contract to create an account or use the Service.
-
One account can be both a Foodie and a Chef. When you sign up you choose which one you will mostly use; a Foodie
can later start selling as a Chef with the same account, and a Chef can order as a Foodie. The app shows one side
at a time and you can switch between them. You cannot order from, book, or review your own kitchen, or use a second
account to do so. A Chef account may additionally enable the Organizer capability to run events.
- You must provide accurate, current, and complete information and keep it up to date.
-
You may browse the Service without an account. Placing orders, booking, paying, messaging, saving favorites,
and AI search require one. You can sign in with your phone number, Google, or Apple.
-
Every account needs a verified mobile phone number and an email address so that Chefs, Foodies, couriers, and
our support team can reach you about orders. If you signed up with Google or Apple, the app asks you to add
any that are missing before you order, sell, or send messages. If you sign in with Apple and choose to hide
your email, Apple's relay address is enough.
-
You are responsible for keeping your sign-in credentials confidential and for all activity under your account.
Notify us promptly at hello@food4foodies.com if you suspect unauthorized
use.
- You may not create an account by automated means, share an account, or transfer an account to another person.
4. The Services
The Service currently includes the following offerings, each subject to these Terms and to any additional terms shown in the app:
- Feeling Hungry: one-off dishes and bundles prepared by a Chef for pickup or, where available, delivery.
- Tiffin4Foodies: recurring meal packs (Tiffin packs) sold as a set number of pickups drawn down over time (Section 8).
- Chef@Home: a Chef travels to a Foodie's home to cook in person (Section 10).
- Delivery: optional third-party courier delivery of eligible orders (Section 9).
- Event4Foodies: discovery of, and ordering ahead from, Chef booths at events run by Organizers (Section 11).
- Truck4Foodies: a Chef sells from a truck at stops they publish, either with no fixed kitchen or alongside their kitchen. Foodies order while the truck is open or, if the Chef allows it, ahead for a later stop, and pick up at the stop. Truck orders are pickup only, and Tiffin packs are sold from a kitchen, not a truck.
- AI4Foodies: optional connection of a third-party AI assistant (such as Claude or ChatGPT) to your account, so that a Foodie can find, order and track food, and a Chef can manage their kitchen, listings and orders, by chatting (Section 15). Other AI tools help Chefs create and manage listings.
We may add, change, or discontinue features at any time. Some features may not be available in every location, and we may make a new feature available to some accounts before others. We may also set limits on how the Service is used (for example, how many kitchen locations a Chef may have, how long a review may be, or the largest driver tip), which may differ by country or by account and may change.
5. Terms for Chefs
-
Legal compliance. You are solely responsible for obtaining and maintaining every permit, license,
registration, inspection, and insurance policy required to prepare, sell, and deliver or serve food where you
operate, including cottage-food, home-kitchen, mobile-vending, parking, and business-licensing requirements. You
must list and sell only food you are legally allowed to sell from the kitchen or vehicle you use, and stop selling
any food you are not allowed to sell. F4F does not inspect any kitchen or vehicle, and has no obligation to decide
whether you may sell a particular food, to require a license or permit, or to prevent you from listing or selling
food you are not allowed to sell.
-
Licensing guidance and badges. Information F4F provides about food licenses, permits, cottage-food
rules, shared kitchens, or costs, in the app or on our website, is general information, not legal advice, and may
not be complete or current for your location; confirm the rules with your state or local health department. If you
add license or permit details to your account, you confirm that they are accurate and current, and you must update
or remove them if they change or expire. Any review F4F makes of those details, and any badge or label F4F shows
(for example, "Licensed kitchen"), reflects only the information you provided at the time it was reviewed. It is not
an inspection, certification, or endorsement of you, your kitchen, or your food, and it does not make F4F
responsible for your compliance. F4F may remove a badge, or limit your listings, at any time.
-
Kitchen locations. If you add more than one kitchen, each one must meet the legal requirements
above for that place (some cottage-food permits cover only the address on the permit). You are responsible for
keeping each kitchen's address, opening hours, dates it is closed or has different hours, and whether it sells
Tiffins accurate, and for preparing each order
at the kitchen it was placed for. Your main kitchen is your profile address. Turning a kitchen off hides it from
new orders; orders already placed there still need to be fulfilled or cancelled so the Foodies are refunded.
-
Food truck stops. If you sell from a food truck, you are responsible for keeping your stops,
times, and menu accurate, for being at a published stop when Foodies have ordered for it, and for parking and
selling only where you are allowed to. If you can't make a stop with orders placed for it, cancel those orders so
the Foodies are refunded.
-
Food safety and accuracy. You are responsible for the safety and quality of your food and for
accurately describing it, including ingredients, allergens, dietary labeling, portion, price, and availability.
Allergen and dietary information you provide is relied on by Foodies. Any estimates generated by F4F tools are
advisory only and do not replace your own responsibility (Section 15).
-
Independent business. You act as an independent business. You are responsible for your own taxes,
including income, sales, and any tax reporting obligations, and for your own insurance. F4F may report payment
information to tax authorities where the law requires.
-
Payouts. Your listings are shown to Foodies, and can be ordered, only once your payout account can receive payments. To receive payouts you must complete onboarding with our payment provider, Stripe, and
keep your payout account in good standing. Payouts are made weekly, currently on Fridays, for funds that have
completed Stripe's processing period (usually a few days after the buyer pays). F4F may change the payout
schedule with notice. Your bank account and payout details are held and verified by Stripe, not by F4F; you
manage them, and keep them current, in your Stripe dashboard, reached from the app's Wallet. Each payment there
shows your payout for that order: the price of what you sold less F4F's commission. What the buyer paid on top
(fees, delivery, tips and sales tax, which F4F collects and, for sales tax, pays to the state) is not part of your
payout and is not shown to you. Payouts are subject
to holds, reversals, and refunds under these Terms.
-
Stripe Connected Account Agreement. Payment processing services for Chefs and Organizers on F4F
are provided by Stripe and are subject to the
Stripe Connected Account Agreement,
which includes the Stripe Services Agreement
(together, the "Stripe Services Agreement"). By agreeing to these Terms or continuing to operate as a Chef or
Organizer on F4F, you agree to be bound by the Stripe Services Agreement, as Stripe may modify it from time to
time. As a condition of F4F enabling payment processing services through Stripe, you agree to provide F4F accurate
and complete information about you and your business, and you authorize F4F to share it, and transaction
information related to your use of the payment processing services provided by Stripe, with Stripe.
-
Orders you accept. When you accept an order you commit to fulfil it as described. You may reject
an order while it is still being prepared; a rejected order is refunded to the Foodie in full (Section 12).
-
Tiffin packs paid by bank account. A Tiffin pack paid by bank account can't be picked up until
the payment clears (Section 7). You may choose to let the Foodie request pickups before it clears. If you do and
the payment later fails, you will not be paid for any tiffins already picked up, and F4F is not responsible for
that amount. Pickups then stop until the Foodie pays by card; after a failed payment they can't be allowed early
again.
-
Enforcement. F4F may remove listings or restrict or close an account for violations of these
Terms, food-safety or legal concerns, inaccurate allergen information, or repeated or serious Foodie complaints.
6. Terms for Foodies
-
Review before you order. Read each listing, including dietary and allergen information, before you
order. F4F does not independently verify a Chef's ingredient claims. If you have a food allergy or dietary
restriction, contact the Chef through in-app messaging before ordering and use your own judgment.
-
Allergies and health are your responsibility. You are solely responsible for deciding whether a
dish is safe and suitable for you and for anyone you order for, including checking ingredients, allergens, and any
health, medical, religious, or dietary concerns before you order and again before you eat. Food on F4F is made in
independent home and commercial kitchens that may also handle common allergens such as peanuts, tree nuts, milk,
eggs, wheat, soy, fish, shellfish, and sesame, so no dish can be guaranteed free of an allergen or of cross-contact,
even when a listing or a Chef says so. If you have a serious allergy or a health condition, ask the Chef before
ordering, inspect the food when you receive it, and do not eat it if you are unsure. By ordering, you accept these
risks.
-
Kitchens and licenses. Chefs are responsible for holding the permits and licenses their food
requires. F4F does not inspect kitchens, and unless a listing shows otherwise, the food may be made in a home
kitchen that a health department has not inspected. A badge such as "Licensed kitchen" means only that the Chef
provided license details that F4F reviewed at the time (Section 5); it is not a guarantee about the food.
-
Payment. Payment is authorized and charged at checkout and processed by Stripe. Foodies pay the
listed price plus an F4F service fee, and sales tax where it applies. A delivery fee applies only if you choose
delivery, and a small-order fee may apply to small orders. Every fee is shown before you pay. Tiffin packs can
also be paid by bank account, with a lower service fee (Section 7).
-
Pickup. Present your name and order number to collect your food. Please arrive during the pickup
window shown for the order.
-
Accurate information. You are responsible for providing a correct delivery or service address and
contact details, and for being reachable for delivery or a Chef@Home visit.
7. Orders, Payments & Fees
-
Processing. All payments and payouts are processed by Stripe. F4F does not store your card number,
expiration date, or security code, or your bank login or account details. By ordering you authorize us and Stripe
to charge your selected payment method for the order total, including any delivery fee and applicable taxes.
-
Paying by bank account. Tiffin packs (Pack of 7 and Pack of 20) and event participation fees can
be paid from a US bank account (an ACH debit through Stripe) instead of a card. Other orders are paid by card.
- Discount. Paying by bank account takes 25% off the F4F service fee on that
purchase (for example, $2.00 off the $8.00 service fee on an $80 pack). The discount is shown at checkout before
you pay, applies only to the service fee (not to the food or participation fee, tax, or any other fee), and F4F
may change or end it for future purchases.
- Timing. A bank payment usually takes 4 to 5 business days to clear. Until
it does, a Tiffin pack's pickups and an event registration wait, unless the Chef (for a pack) or the Organizer
(for an event) chooses to let them go ahead. You are notified when it clears.
- Event4Foodies. An event participation fee can be paid by bank account only when the event starts
at least 7 days later, so the payment can clear in time.
- Authorization. When you pay by bank account you authorize Stripe, on F4F's behalf, to debit
your account once for the amount shown. You connect the account through Stripe, by signing in to your bank or
entering your account and routing numbers.
- If a bank payment fails. If your bank returns the payment (for example, for insufficient
funds or a closed account), you'll be asked to pay again, by card only. Pickups or registration wait until you
do, and can no longer be let go ahead early. A pack whose failed payment isn't paid again within 3 days is cancelled. Your bank may charge you its own fee
for a returned payment.
-
Chef commission. F4F charges Chefs a commission on the food total of each completed order:
12% on pickup orders (including Tiffin and event pickup orders) and Chef@Home bookings, and
15% on delivery orders. There is no monthly subscription and no listing fee. The commission is
deducted from the Chef's payout.
-
Delivery fee. The fee for a courier is paid by the Foodie and is shown before checkout. It covers
the courier's charge plus an F4F markup. It is not part of the Chef's earnings and no commission is taken on it.
-
Taxes. Prices may not include applicable taxes. Chefs are responsible for determining and remitting
taxes on their sales unless the law requires F4F to collect and remit them.
-
Currency. Amounts are shown and charged in the currency of the Chef's account (currently U.S. or
Canadian dollars).
-
Changes. We may change our fees or commission rates. We will give reasonable advance notice, and
a change will not affect orders already placed.
-
Off-platform payments. You agree not to use the Service to arrange payment outside F4F in order to
avoid fees on transactions that began on the Service.
8. Tiffin Packs
A Tiffin pack is a prepaid set of pickups (for example, a pack of 7 or 20) that the Foodie draws down by requesting
individual pickups over time. Each pack has a validity period shown at purchase, after which unused pickups expire
and are not refundable except where the Chef agrees to extend the pack or where required by law. A Chef may extend
a pack's expiry but may not shorten it. Pickups can be requested once the Chef has accepted the pack and its payment
has cleared, and then follow the Chef's availability and the request and acceptance steps shown in the app.
Delivery of an individual Tiffin pickup, where offered, is arranged and paid for per delivery, and the Chef
prepares it only after that delivery fee is paid.
9. Delivery
-
Independent couriers. Delivery is performed by an independent third-party courier network that we
engage on the Foodie's behalf. The courier's own terms may apply to the delivery. F4F does not employ couriers
and does not control how they perform.
-
Eligibility and quotes. Delivery is offered only for eligible orders and addresses, and a delivery
fee quote is valid for a limited time. Delivery of multi-pickup packs is not currently offered.
-
Foodie responsibilities. You must provide an accurate, reachable address and any access
instructions, and be available to receive the order. Food left with you or at your instructed location is at your
risk once delivered.
-
Failed or cancelled deliveries. If a delivery cannot be completed for reasons that are not your
fault, we may cancel the order and refund it. If a delivery fails because the address was incorrect or the recipient
was unavailable, the order may be non-refundable in whole or in part.
-
Order and tracking information. To complete a delivery we share the recipient's name, phone number,
delivery address, order number, and delivery instructions with the courier network (see our
Privacy Policy).
10. Chef@Home
Chef@Home is an arrangement in which a Chef travels to a Foodie's home to cook in person, billed hourly or by the
day as shown at booking. Because it involves meeting a stranger in a private residence, both the Chef and the Foodie
must complete identity verification (Section 13) before a Chef@Home booking can be offered or made. Both parties
remain responsible for their own safety and conduct, for the suitability of the home and its kitchen, and for any
equipment, ingredients, and cleaning arrangements they have agreed. Inviting a Chef into your home is at your own
discretion and risk. F4F does not supervise a Chef@Home visit and is not liable for events occurring during one,
subject to applicable law.
11. Event4Foodies
-
Organizers. An Organizer is a Chef who has enabled the Organizer capability and who alone is
responsible for the event: its venue, permits, insurance, safety, capacity, schedule, and conduct. Event details,
including the address and schedule, are visible to the public.
-
Joining as a Chef. A Chef may request to join an event until the Organizer's registration cutoff, or
may be invited by the Organizer. An Organizer may still invite Chefs after registration closes. If an event has a
participation fee, the Chef pays it when sending a request, or when accepting an invitation, and is registered
once the fee is paid and, for a request, the Organizer accepts. A paid event takes registrations only once its
Organizer's payout account can receive payments.
-
Participation fee refunds. The fee is refunded in full if the Organizer declines the request, if
the Chef cancels a pending request, or if the event is cancelled. A registered Chef may cancel up to 24 hours
before the event starts for a full refund; cancellation is not available inside that window. An Organizer may
remove a registered Chef at any time and decides whether the fee is refunded in full, in part, or not at all. If
a Chef is removed, that Chef's open Foodie orders for the event are cancelled and refunded in full.
-
Ordering at an event. Foodies order ahead from a Chef's booth for pickup at the event by presenting
their name and order number. Event orders are pickup orders and follow Sections 7 and 12.
-
F4F fees on participation fees. The participation fee is set by the Organizer and is paid
through F4F's payment provider to the Organizer. F4F takes a commission on it from the Organizer's payout, and
the Chef pays an F4F service fee on top of it. Both are shown before the fee is paid.
-
Participation fees paid by bank account. A Chef whose fee is paid by bank account is registered
once the payment clears (Section 7). The Organizer may choose to register the Chef before it clears. If the
payment then fails, the Organizer will not receive that fee and F4F is not responsible for it; the Chef stays
registered and is asked to pay again by card, and the Organizer may cancel the Chef's registration. A Chef not
yet registered when their payment fails can't be registered early; they're registered once they pay by card.
-
Invitations. An Organizer may invite a Chef by phone number or email address. An invitation is
shown to the Chef in the app when the contact information matches a Chef account, and may be held until a matching
account exists. You may not use invitations to send unsolicited messages.
12. Cancellations, Refunds & Complaints
-
Cancelling or rejecting an order. A Foodie may cancel an order, and a Chef may reject it, while the
order is still being prepared: for pickup and delivery orders, until it is marked ready for pickup or handed to
the courier; for Chef@Home, until the visit begins. The Foodie is refunded in full to the original payment
method. A Tiffin pack can be cancelled only while none of its pickups has been prepared or collected.
-
After that point. Once an order is ready, out for delivery, or complete, it can no longer be
cancelled through the app. If a problem arises, use the complaint process below.
-
Complaints. If something is wrong with an order, a Foodie may file a complaint within
24 hours of pickup or delivery, describe the issue, and attach evidence photos. The Chef is
notified and can respond through the complaint thread, then approve or deny it. An approved complaint refunds
the food in the amount the Chef sets, up to the food not already refunded, together with the sales tax on that
food. Service and small-order fees, delivery fees and driver tips are not refunded through a complaint. Only one
complaint may be open on an order at a time.
-
How refunds are paid. Refunds are issued by Stripe to the original payment method, including
to the bank account for a purchase paid by bank. Refunds reduce the Chef's payout accordingly, and the related
platform commission is returned in proportion. Banks may take several business days to show a refund. A purchase
paid by bank that is cancelled before the payment clears is refunded once it clears.
-
F4F review. F4F may, but is not required to, review a complaint, its evidence, and its outcome,
and may in appropriate cases issue or reverse a refund or restrict an account. The complaint process is a way for
the Foodie and the Chef to settle an order between themselves; it is not a legal determination of fault, and F4F's
decision whether to review or act does not make F4F responsible for the dispute (Section 2). Repeated or unresolved complaints may result in account
review under Section 23.
-
Chargebacks. Please contact us before disputing a charge with your bank. We may share information
about the order with Stripe and your card issuer to respond to a dispute.
13. Identity Verification
F4F offers optional identity verification, powered by Stripe Identity, as a trust signal. Verified accounts receive a
badge and, for Chefs, preferred placement in search. Verification is required to offer or book a Chef@Home visit.
Your identity document and selfie are collected and processed directly by Stripe under Stripe's terms and privacy
policy; F4F receives and stores only the result of the verification (verified, pending, or not verified). A badge
indicates that a check was completed at a point in time. It is not a background check, a guarantee of character, or
an endorsement by F4F.
14. Messaging & Communications
-
In-app messaging. The Service lets Chefs, Foodies, and Organizers exchange messages and photos
about an order, a complaint, or an event. Use messaging only for that purpose, and not for harassment, spam,
solicitation, or arranging transactions off the Service.
-
Review of messages. Messages are stored on F4F's systems and may be reviewed by F4F to resolve a
complaint or dispute, investigate a report, enforce these Terms, prevent fraud and abuse, provide support, or
comply with law.
-
Service communications. By creating an account you agree that we may send you push notifications,
in-app notices, and emails about your orders, account, security, and these Terms, and text messages with one-time
verification codes you ask for. You can control push notifications in your device settings. Message and data rates
may apply to text messages.
-
Order texts. Text messages about your orders are sent only if you turn on Order texts in the app,
to your verified phone number. Message frequency varies with your orders. Message and data rates may apply. Reply
STOP to stop and HELP for help, or turn them off in the app at any time. Consent is not a condition of any purchase.
We don't send marketing texts through this program. See Order Texts and our
Privacy Policy.
15. AI Features & Connected Tools
Some parts of the Service use artificial intelligence, including tools that read menus or listings, suggest bundles,
check dietary labels and estimate nutrition. AI output can be inaccurate or incomplete. Estimated calories,
macronutrients, and dietary or allergen checks are advisory only, are not lab-verified, and must not be relied on for
medical, allergy, or dietary decisions. Chefs remain solely responsible for the accuracy of everything they publish,
and must review AI-generated content before publishing it. Content you submit to these tools is processed by our AI
service providers as described in the Privacy Policy.
AI4Foodies (connected AI assistants). You may connect a third-party AI assistant to your account by
signing in on our page, or by making a key in the app. A connected assistant acts on your instructions and with your
authority. Anything it does through your account, such as searching, placing or cancelling orders, changing
listings, or accepting, declining or messaging about orders, is treated as done by you, and you are responsible for
it. Before it cancels or declines an order or turns your account into a Chef account, it must ask you to confirm. An
assistant can never pay: every order it places is paid by you on our own payment page, which shows the Chef, items
and total, and an order is not sent to the Chef until it is paid. An assistant cannot accept these Terms for you,
change your email, phone, password or bank details, or delete your account. We check prices, availability and every
rule on our side; we are not responsible for what an assistant tells you, for its mistakes, or for the assistant
itself, which is governed by its provider's own terms. You can disconnect an assistant at any time in the app, and we
may disconnect one that has not been used for a period of time or that we believe is being misused. Keep any key you
make secret, as you would a password.
16. Content, Reviews & License
You retain ownership of the content you submit, such as photos, listings, bios, messages, and reviews. You grant F4F a
worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, and
distribute that content in connection with operating, promoting, and improving the Service. You represent that you
have the rights to grant this license and that your content is lawful and does not infringe anyone's rights. Reviews
must reflect a genuine experience; fake, incentivized, or retaliatory reviews are prohibited. We may remove content
that violates these Terms, and we may respond to notices of alleged infringement in accordance with applicable law.
17. Acceptable Use
You agree not to:
- violate any law, including food-safety, health, licensing, tax, privacy, and consumer-protection law;
- harass, threaten, defame, discriminate against, or endanger any person;
- misrepresent your identity, credentials, a dish's ingredients or allergens, or the nature of an event or visit;
- circumvent the Service's payment system, fees, or safety features;
- post false, misleading, or fraudulent listings, events, or reviews;
- scrape, harvest, or bulk-collect data from the Service, or use it to build a competing product;
- copy, modify, decompile, disassemble, or reverse engineer the app or any part of the Service, except where the law expressly allows it despite this limit;
- probe, disrupt, overload, or gain unauthorized access to the Service or other accounts, or introduce malware;
- use the Service to send unsolicited or unrelated messages, or to contact people outside the context of an order, complaint, or event.
18. Third-Party Services
The Service relies on and links to third-party services, including Stripe (payments, payouts, and identity
verification), independent courier networks, map and address services, and AI providers. Your use of those services
may be subject to their own terms and privacy policies. F4F is not responsible for third-party services, and their
availability or performance may affect the Service.
Google Maps. The Service uses Google Maps Platform for address search, maps, and directions. By
using those features you agree to be bound by the
Google Maps/Google Earth Additional Terms of Service
(including the Google Privacy Policy).
On Apple devices, maps are shown with Apple Maps, under Apple's terms.
19. Intellectual Property
The Service, including its software, design, text, graphics, and the Food4Foodies name and logos, is owned by Food For Foodies, LLC (F4F) or
its licensors and protected by intellectual-property law. We grant you a limited, revocable, non-exclusive,
non-transferable license to use the Service for its intended purposes under these Terms. All rights not expressly
granted are reserved.
20. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR
STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. F4F DOES
NOT WARRANT THE QUALITY, SAFETY, LEGALITY, OR SUITABILITY OF ANY FOOD, CHEF@HOME SERVICE, DELIVERY, OR EVENT; DOES NOT
WARRANT THAT ALLERGEN OR DIETARY INFORMATION IS ACCURATE; DOES NOT WARRANT THAT ANY CHEF HOLDS, OR COMPLIES WITH, THE
PERMITS OR LICENSES THEIR FOOD REQUIRES, INCLUDING WHEN A BADGE IS SHOWN; AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED
OR ERROR-FREE. F4F IS A MARKETPLACE PLATFORM AND IS NOT A PARTY TO THE TRANSACTIONS BETWEEN USERS. SOME JURISDICTIONS
DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, F4F AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS,
REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY TRANSACTION BETWEEN USERS, INCLUDING
FOODBORNE ILLNESS, ALLERGIC REACTION, A CHEF'S SELLING FOOD WITHOUT A REQUIRED PERMIT OR LICENSE, PERSONAL INJURY OR
PROPERTY DAMAGE DURING A CHEF@HOME VISIT, THE ACTS OR OMISSIONS OF A COURIER, OR INCIDENTS AT AN EVENT. F4F'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT
EXCEED THE GREATER OF THE FEES YOU PAID TO F4F IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND ONE HUNDRED U.S. DOLLARS
(US$100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
Release. Because F4F is not a party to transactions between users, if you have a dispute with a
Chef, Foodie, Organizer, or courier, including about food, allergies, illness, or injury, you release F4F and its
officers, directors, employees, and agents from claims, demands, and damages of every kind arising out of or
connected with that dispute, to the maximum extent permitted by law. If you are a California resident, you waive
California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or
releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that,
if known by him or her, would have materially affected his or her settlement with the debtor or released party."
22. Indemnification
You agree to defend, indemnify, and hold harmless F4F and its affiliates, officers, directors, employees, and agents
from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of your use of the
Service, your content, your food or event, your transactions with other users, your failure to obtain or keep any
permit, license, registration, or insurance you need, or your violation of these Terms or of any law or third-party
right.
23. Suspension & Termination
You may delete your account at any time in the app. A deleted account is deactivated immediately, signed out on every
device, and, if it signs in with Apple, its access to your Apple ID is revoked. It then enters a 30-day
grace period, after which it and its associated data are permanently deleted except as described in our
Privacy Policy. F4F may suspend, restrict, or disable an account or content at any time,
with or without notice, for a violation of these Terms, to protect the safety of users, to comply with law, or for
risk or security reasons; a disabled account may be re-enabled after review. Open orders, refunds, fees owed, and
provisions that by their nature should survive (including Sections 12, 16, 19 through 22, and 24) survive
termination.
24. Dispute Resolution & Governing Law
Informal resolution first. Before starting a formal proceeding, you and F4F agree to try to resolve
any dispute informally by contacting legal@food4foodies.com and allowing
at least 30 days to negotiate in good faith.
Binding arbitration. If a dispute is not resolved informally, you and F4F agree that it will be
resolved by final and binding arbitration on an individual basis rather than in court, except that either party may
bring an individual claim in small-claims court and either party may seek injunctive relief in court to protect its
intellectual property or confidential information. YOU AND F4F WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO
PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Arbitrators may not consolidate claims of different
users.
Governing law. These Terms are governed by the laws of the jurisdiction in which F4F is organized,
without regard to conflict-of-law principles, except that the arbitration provisions are governed by the Federal
Arbitration Act where it applies. Nothing in this section limits rights you may have under mandatory consumer law
of your place of residence.
25. Changes to These Terms
We may update these Terms from time to time. For minor changes we will update the date at the top of this page. For
material changes we will give you notice and require you to accept the updated Terms before you continue using the
Service: in the app the next time you open it, or, if you use F4F through a connected AI assistant or an API key, on
the web page we link to, where you confirm with a code texted to your account's phone number. Assistants and API keys
keep working for a grace period after we publish material changes (15 days unless the notice says otherwise); after
it, they stop working until you accept. Your continued use after the effective date
of an update means you accept it.
26. General Provisions
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and F4F about the Service.
- Severability. If a provision is held unenforceable, the rest of the Terms remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Notices. We may give notice by posting in the Service, in-app message, or to the email or phone number on your account.
- Force majeure. Neither party is liable for a delay or failure caused by events beyond its reasonable control.
